He has been in police custody since he was arrested over a month ago. The trial judge, justice Adolphus Enebeli however said David West is still not guilty in the eyes of the law, adding that there is need for more evidence to prove the matter. Lawyer to the accused person, Vincent Chukwu explained why the court said his client Gracious David West is not guilty of the charges despite pleading guilty at the opening of the trials.
He said” that is elementary law. Because it is a capital offence. Whether you did it or not, the presumption is that the prosecution should prove their case beyond reasonable doubt. So the burden is on them. It is not for the defendant to just say I am liable or guilty and therefore it ends there. Because the punishment is death. The burden is on them to prove their case. We are waiting for them ”
